Most people believe that court costs and attorneys are extremely expensive. While that is true in the majority of cases, Small Claims Court is relatively inexpensive. No attorneys are required in the state of Texas and the plaintiff can sue for up to $10,ooo. The filing fee is only $99 for each case. However, costs do go up if the plaintiff chooses to sue more than one defendant.
Lets assume that you are a renter who did not receive the preliminary deposit you placed when your first moved in. Under Texas law, the landlord must return your deposit within 30 days, or provide you with an itemized list of charges that were incurred.
Here are some simple steps you will need to follow. You can go down to your local county courthouse and file suit against the owner. You will need his personal contact information, money to pay for the lawsuit, and you can fill out the necessary forms while you are there. The defendant will be served.
