Evictions can be a nasty process. Both the renter and the apartment manager lose in this situation. If a tenant is evicted a constable actually will supervise the entire move-out process. But the tenant still has rights and a legal process must be involved.
Here is how it works. An eviction is usually used for a tenant who fails to pay his monthly rent. But it can also be used for tenants who continually fail to obey the rules at the community.
If you are a tenant, and the apartment community files an eviction against you, you will be notified. The property manager or a representative from the community will go down to the local courthouse, pay the fees, and file the eviction. They will have to proved that you violated the terms of the contract.
Once you are notified, you may want to hire an attorney to protect yourself. However, most people who don’t pay their monthly rent, cannot afford to hire an attorney to protect their interests. There are some non-profit organizations that provide free legal advice.
